• If you do not agree to all the terms and conditions of this agreement, then you must not access the website or place any order. All items offered for sale are subject to these Conditions, as may be amended from time to time.

Client warranties

• By using the website, you represent and warrant that:
• You are a person who has reached the age of majority as defined in South Africa; and
• You are not subject to any legal prohibition preventing you from using the website or purchasing items offered on the website.
• You undertake and warrant that you will provide accurate and complete information when registering as a Move client (if required), updating your profile, or placing an order, including email address and payment details.

Electronic Communications

• When you (“Client”) visit move.store or send emails to MoveCom (Pty) Ltd (“Move”), you consent to receive communications electronically and agree that all agreements, notices, disclosures, and other communications sent by Move satisfy any legal requirements, including that such communications be “in writing”.

Limitations

• No person, business, or website may link to any page on this site without prior written permission from Move. No person or business may use technology to search, extract, or gather information from this site without prior written permission. Permission may be requested by emailing info@move.store.
• Move reserves the right to limit the sale of items to any person or geographic region. This may be exercised on a case-by-case basis.
• Move reserves the right to limit the quantities of any items offered.

• Neither Move nor any of its representatives shall be liable for any damage, loss, or liability arising from the use or inability to use the website or its content. Move makes no representations or warranties that the website will be uninterrupted, error-free, or free from omissions.
• This website does not cater to the Client’s individual requirements. It is the Client’s responsibility to ensure that the products and services meet their needs.
• Information and opinions on this site should not be regarded as professional advice. Clients should seek appropriate guidance if needed.
• This site may contain historical or outdated information, provided for reference only. You agree it is your responsibility to monitor updates or changes.
• Move makes every effort to accurately display images and colours of products, but cannot guarantee that the display on your device is accurate.
• Move may discontinue any item at any time.

Costs

• Product prices are displayed with each item and include VAT. Prices are subject to change without notice.

Inspection of goods

• An accountable person must inspect and sign for goods at delivery. Move cannot accept liability for damages or errors once goods have been assembled, fitted, or in the Client’s possession for more than 7 days. Original packaging must be retained for any return.

Agreements of Sale

• Placing an item in the cart without completing payment does not constitute an agreement of sale. Move is not liable if items become unavailable before checkout.
• An agreement of sale is only concluded once Move confirms acceptance of an order.

Move:

• Reserves the right to refuse or cancel an order if full payment is not received timeously.
• Will correct pricing errors as soon as discovered. Items will be sold at the corrected price.

Inadvertent and Obvious Errors

Move is not obligated to supply products affected by obvious or technical errors in pricing, descriptions, or images. If an order is canceled due to such an error, a full refund will be issued.

Stock Availability

• All stock is limited. Move will discontinue listings once stock is sold out.
• Move is not liable for stock shortages beyond its control.

Privacy

• Move shall take all reasonable steps to protect the personal information of Clients.
• Move may electronically collect, store and use the following personal

  • Banking details
  • Banking card details

  • For purpose of identifying the Client when he/she accesses the Move website;
    
  • Subject to the Client's consent, inform the Client of facts relating to his/her access and use of the Move website;
    
  • Subject to the Client's consent, inform the Client about competitions and special offers offered by Move.
    
  • To verify the identity of the Client when transacting with Move.
    
  • To ensure that the goods are received by the addressee.
• The information detailed above is provided voluntarily by the Client. Move may collect, maintain, save, compile and share any information collected from Clients, subject to the following provisions:
  • Move may share personal information and/or use 'cookies' that track website preferences for targeted advertising on platforms like Facebook and Instagram. This includes, but is not limited to, the installation of a Meta Pixel and the use of cookies for services such as Google Analytics and Google Ads.   • Move shall disclose information without the Client's consent only through due legal process; and
  • Move owns and retains all rights to the non-personal statistical information collected and compiled by Move.

Errors, inaccuracies and omissions

• Move may correct any errors, inaccuracies, or omissions on the website at any time and without prior notice.

Severability

• If any provision of these Conditions is deemed unlawful or unenforceable, that portion shall be severed without affecting the validity of the remaining provisions.

Termination

• All obligations incurred prior to termination survive the termination of these Conditions.
• You may terminate these Conditions by notifying us that you no longer wish to use the website.
• Move may terminate your access at any time without notice if you fail to comply with any provision of these Conditions.

Waiver, Entire Agreement and Variation

• Failure by Move to enforce any provision does not constitute a waiver.
• These Conditions constitute the entire agreement between you and Move regarding the website.
• Only Move may amend these Conditions, which become effective once published on the website.

Governing Law and Jurisdiction

• These Conditions are governed by the laws of South Africa.
• South African courts have exclusive jurisdiction over any disputes arising from these Conditions.
